Terms of Service

Welcome to Floor Is Lava Class (“we,” “our,” “us”). By registering yourself or your child for our programs, you agree to the following terms and policies. These Terms of Service, including the Injury Waiver and Release of Liability, apply to all Floor Is Lava Class programs, including group classes, after-school programs, workshops, and special events.

1. Enrollment and Payments

Enrollment does not renew automatically. Registration is required for each session.

  • School-handled programs (Henrietta Lacks Elementary School). Tuition is handled directly by the school or PTA. The school may require its own registration form, and it is the parent’s responsibility to complete any school-specific requirements. Registering through this website provides us with contact information, waiver acknowledgment, and roster details, but does not handle payment.
  • Programs handled directly by us (Charles E. Smith Jewish Day School). Registration and payment are completed through this website. Enrollment is not confirmed until payment is received.

Unless otherwise noted, all payments are non-refundable. Enrollment is for the full session, and tuition is not adjusted for absences, vacations, schedule conflicts, or early withdrawal.

2. School Enrollment Requirement for School-Based Classes

For any class held at a listed school location as part of that school’s enrichment, after-school, or ancillary programming, the enrolled student must be currently attending that specific school at the time of registration and during participation in the program. Students who previously attended that school, but are no longer currently enrolled there, are not eligible to register for that school’s class. This requirement applies only to school-based programs and does not apply to private bookings, workshops, or other non-school-based events, unless otherwise stated. This is due to school policy, and Floor Is Lava Class reserves the right to deny, cancel, or remove any registration that does not meet this requirement.

3. Private Bookings and Special Events

These Terms, including the Injury Waiver and Release of Liability, apply to all Floor Is Lava Class programs, including workshops and special events. Payment for these services is typically handled by invoice through a secure third-party processor. By paying an invoice, you agree to the charges described and acknowledge acceptance of the Terms of Service and Injury Waiver. For recurring invoices, payment constitutes authorization for Floor Is Lava Class to process charges for each scheduled session until cancelled in writing.

4. Cancellations, Weather, and Makeups

  • If a class is canceled by Floor Is Lava Class due to instructor illness, emergency, or other unforeseen circumstances, a makeup class or credit toward a future session will be provided. Cash refunds are not issued unless the program itself is canceled.
  • Makeup classes and credits apply only to classes canceled by Floor Is Lava Class. We do not offer makeups, credits, or refunds for student absences.
  • Classes canceled due to weather, school closure, or other events outside our control are not refundable.
  • If two or more classes are canceled during a single session due to weather or other force majeure events, not necessarily consecutive, Floor Is Lava Class will offer one makeup class or one credit toward a future session.

5. Communication

  • Email is our official method of contact. All updates, cancellations, and important information will be sent to the address or addresses you provide.
  • We do not send marketing emails. Communication is limited to program participation.

6. Injury Waiver and Assumption of Risk

Participation in physical activity carries inherent risks. By registering, you affirm that you, or your child, are in good physical condition and able to participate. You acknowledge these risks and agree to release Floor Is Lava Class, its owners, employees, subcontractors, independent contractors, instructors, assistants, and partner schools from liability for any injury, illness, or condition arising from participation, except in cases of gross negligence.

You also acknowledge and agree to the terms of our Injury Waiver and Release of Liability.

7. Photo Use and Consent

  • Class reports (required). By enrolling, you agree that Floor Is Lava Class may take photos and short video clips during class sessions. These are used exclusively for class reports, which are shared privately with the parents and guardians of enrolled students in that class.
  • Promotional use (optional). Parents may voluntarily opt in to allow photos and videos to be used for promotional purposes.

8. Student Conduct

Students are expected to follow class rules, respect instructors, and behave safely. We reserve the right to remove any student whose behavior is disruptive or unsafe.

9. Intellectual Property

All teaching materials, curriculum, and content created by Floor Is Lava Class remain our property.

10. Limitation of Liability

Total liability for any claims related to participation shall not exceed the total tuition paid.

11. Governing Law

These Terms are governed by the laws of the State of Maryland, USA.

12. Updates

We may update these Terms from time to time. Continued participation in our programs means you accept the updated Terms.
